An interesting objection to the War On Drugs

Lawrence posts an interesting and different view on the War On Drugs: that's it's unconstitutional.  I am not a lawyer but his is an interesting argument even if from a practical matter that ship has sailed.

But you can have my "two spaces after a period" when you pry it out of my cold, dead fingers.  I learned that in 8th grade typing class and that ship has sailed.  Please everybody, no flame wars on the Oxford Comma, either ...

That's always been my objection to it. Not for the reasons he stated, but because of the 18th Amendment.

The 18th Amendment was passed because they knew that the Constitution did not give the Feds the power to ban alcohol without an actual Constitutional Amendment. I've heard the 18th referred to as "the last 'Constitution means what it says' amendment."

If the Feds knew they couldn't ban alcohol without a formal amendment, what gave them the power to ban other drugs?

Doing nothing is unethical. A constitution without morals and ethics is nothing, BP. Pretty much every third world chit hole has a flowery and glowing constitution that isn't worth the paper it's printed on. It'd be a shame to see the American constitution devalued that way - but that is where it's going.

And this is the conundrum we have: the bad guys are playing our best qualities against us. Love and Truth are fine and noble things, but the guy that has Truth with no Love rapidly finds himself an unprincipled religious or political zealot. The liberals and libertarians that have Love without Truth will destroy themselves tolerating things that they shouldn't.


So LAWYERS are to be the conscience of the nation, now? May God have mercy on us.

Didn't I say just that in my response to earlier post? Devolve the issue to the states where it belongs and get fed gov out of it and make that the start of getting it out of everything else it has no business in...

The vast majority of the things the Fed Gov does is in violation of the Constitution. The ugly reality is that the Constitution is just ink on paper....like a 'restraining order'. Neither item has the power to restrain anyone willing to violate the words written on said pieces of paper. The 'restraining' comes from "we the people" and that means the threat of and if necessary the use of violence. Politicians seek office to gain power. With RARE exceptions they will
NEVER willingly obey ANY rule that limits their access to and ability to wield power. Power is THE MOST addictive thing to humans in all of history.

Contrary to popular belief, 95%+ of all drug arrests are by State and local cops, under their own laws. The DEA goes after major distribution rings, on the legal grounds that they are transporting drugs across State and national boundaries.
