What can you purchase using a Massachusetts Driver's License as ID?


Hello, Evil Black Rifle.  With high standard capacity magazine.  But now for the punchline: Your Massachusetts Driver's License is a valid ID to purchase this in Georgia, but not in Massachusetts.

And the air smells like Freedom down here, too.

UPDATE 15 December 2010 00:55: Welcome visitors from View From The Porch.  In the interests of full disclosure, I have to say that I actually haven't bought this rifle yet, even though (a) it's wicked sweet, and (b) I could, with my Mass Driver's License (well, in Georgia, at least).

That said, it seems that those of us in the Free portions of the Republic are obliged to purchase weapons banned in the UnFree portions of the Republic.  If the Great State of Schmuckolina decides that banning, say, a Ruger Blackhawk is a top priority, we should all go out quick like a bunny and buy one.   If enough of us outweigh the banners, we'll get the gun manufacturers building for us.

Didn't know you could buy a gun (even in Georgia) with an out of state drivers license. Or is it just health insurance that has to be from the same state you live in?

Go through the hassel of getting a Georgia CCW and there won't be a waiting period when you buy a gun. Plus it's fun to show your CCW as ID to the little old lady poll watchers on election day...

No waiting period now, even without a CCW-unless you count the time the clerk spends on the phone to get the approval number.

As far as the license, an out-of-state DL will only let you buy long guns-gotta be in-state for handgun purchases.

To be specific, Georgia doesn't have a CCW, they have a Georgia Weapon License.

And it only took me 2 days to get mine in Dade Co!

I'm not sure you can buy that particular rifle with a MA DL. Doesn't the rifle have to comply with both the laws of the FFL's state of operation and the buyer's state of residence in order for the FFL to legally transfer it?

Not sure of that, but who says he's not intending to leave it in GA? Or take it to his second home in another free state? Shouldn't matter.

He could use his MA driver's license for ID and utility bills or viehicle registration to as proof of residency in GA. The FFL would photocopy the document and attach the copy to the Form 4473.

The air used to smell much better in Mass. 21 years ago, I bought an HK91 in Grafton with my MA FID card. The FID card the police Chief gave me when I was 18 without a background check while he was asking after my mother and grandmother.

I bought the HK because the place (forgot the name) in Boylston was asking too much for the Steyr AUG.

I moved out of MA 19 years ago and won't move back until the air clears.

I remember buying a rifle in Mississippi with a Maryland drivers license oh so many years ago.
I'm sure MD will soon prevent that "loophole"...

Cute M4-gery, although that appears to be a lightweight barrel?

While I hate to rain on your parade, there appear to be two legal concerns with buying a black rifle out of state:

1) 18USC922(3) and (b)(3) state that the gun has to be legal in the state of purchase and state of residence, with no exception for leaving the item in the state of purchase.

2) I couldn't find legal reference for this, but typically black rifles ("semi-automatic military-style assault weapons" in anti-gunner legalese) are treated as handguns for purposes of purchase, i.e. you have to be 21 and if in a state that requires a permit to purchase for pistols, that permit must be obtained. (This is true in MN, anyway.) Should this be part of federal law, then it would preclude purchasing black rifles over state lines as well.

Which brings up an interesting question: will the NICS check come back denied in the above case?

I moved to Vermont a few weeks ago, and had a similar squee moment when I ordered the Saiga-12 drums I've lusted after since forever.

Moved outta NY the fourth of November, right after the election failed.

Your example #2 may well betrue in Minnesota, but it is not federal law. A semiauto rifle that is neither an NFA controlled "Short Barrelled RIfle" nor is made of 10 or more imported parts from the Big List Of Evil Gun Parts is just. . . a rifle.

But, yes, teh FFL is only supposed to sell longarms interstate IF it is legal in both states -- which is why many FFLs (unless they liveright on the state line) won't make an interstate sale to a regular Joe.
